The accused attorney must file an answer, or risk a default judgment and involuntary enrollment as an inactive Bar member pending the outcome of the case. The next step depends on the individual case. There could be additional status conferences, settlement conferences, or simply the trial date.

The Family Relations Counselors who work in Family Services will:

  • Review all family violence arrests
  • Conduct assessment interviews and make recommendations to the court about what should happen with the cas
  • Keep track of the progress of cases that the court refers to Family Services for pre-trial case management

There are consumer protection statutes that sometimes give borrowers a cooling off period when they can change their minds. The Truth in Lending Act, for example, gives a consumer the right to cancel certain real estate loans within three business days without penalty. However, it's critical to understand that these protections will usually apply only to limited consumer transactions. The chances are that they won't apply to a business or commercial loan.

The period of limitation is different for different types of offences. The period of limitation is –

  1. 6 months, if the offence is punishable with fine only.
  2. 1 year, if the offence is punishable with term up to 1 year.
  3. 3 years, if the offence is punishable with imprisonment of more than 1 year but not exceeding 3 years.

Normally, once the cognizance has been taken, the case proceeds and after full trial, results in conviction, acquittal or discharge of the accused. However, there are circumstances when it is not desirable to adopt the course of full trial. In some situations, the further trial becomes impossible or infructuous. 

The Equality and Human Rights Commission works towards the elimination of racial discrimination and to promote equality of opportunity and good relations between different racial groups. It takes on some cases, and refers on those for which it does not have the resources. Usually the referrals are to law centres.
