Constitutional Matters

A constitutional matter includes any issue involving the interpretation, protection or enforcement of the Constitution. Supreme Court of Appeal. 168. (1) The Supreme Court of Appeal consists of a President, a Deputy President and the number of judges of appeal determined in terms of an Act of Parliament.
The Constitutional Court is the highest court in the country when it comes to the interpretation, protection and enforcement of the Constitution. It deals exclusively with constitutional matters - those cases that raise questions about the application or interpretation of the Constitution.
Some examples of constitutional law, include the following: Assistance of Counsel – this right extends to individuals that are accused of a crime and stipulates that an attorney will be appointed for the defendant, if they cannot afford to hire their own.
