Criminal Law is a system of laws concerned with punishment of individuals who commit crimes. A “crime” is any act or omission in violation of a law prohibiting it, or omitted in violation of a law ordering it. The government cannot prosecute an individual for conduct that was not declared criminal at the time the individual has acted on it.

Elements of a Crime

Every crime involves three elements:

  1. The act or conduct (“actus reus ”)
  2. The individual’s mental state at the time of the act (“mens rea ”)
  3. The causal link between the act and the offence

Indian Criminal Laws

Indian Criminal Laws are divided into three major acts i.e.

  1. Indian Penal Code, 1860
  2. Code of Criminal Procedure, 1973
  3. Indian Evidence Act, 1872
