AFFIDAVIT OF THE ATTESTING WITNESS OF THE WILL.

Affidavit of Sh. xxxxxxxx aged about ___ years, S/o Late Sh. xxxxxx R/o xxxxxxxxx, Delhi-110085., do hereby solemnly affirm and declare as under:-

1.                 That I, the Deponent, am well conversant with the facts and circumstances of the case, and hence competent to swear this Affidavit.

2.                 I am one of the Witness to the Will dated xxxxxxx of Late Smt. xxxx W/o Late xxxx who died on xx.xx.xxxx.

3.                 I state that the Will dated xx.xx.xxxx was executed by Smt. xxxxxx by her own sweet will and choice, without any force, pressure, threat or inducement from any corner. Smt. xxxx executed the said Will in presence of the witness Deponent herein and other witness Mrs. xxxxx W/o Sh. xxxxx R/o C-xxxxxxxx, Delhi. Copy of Will dated xx.xx.xxxx is Ex.PW2/1. Copy of Adhar Card are Ex.PW2/2.

4.                 I further state that the other witness Mrs. xxxxxx W/o Sh. xxxxx xxxx R/o xxxxxxx, Delhi had also signed on the said Will dated xxxxx in my presence.

5.                 I further state that the said Will dated xx.xx.xxxx was signed in my presence and the executant was having sound and healthy mind at the time of executing Will and without any influence from any quarter.

6.                 I further state that Smt. Asha Goel has been bequeathed her share i.e. 50% in immovable property bearing xxxxxx, xxxx, Delhi as per her last Will dated xx.xx.xxxx in favour of the Petitioner leaving the other legal heirs.

7.                 I hereby state that whatever is stated hereinabove is true and correct to the best of my knowledge.
