APPLICATION FOR AND ON BEHALF OF APPLICANT SEEKING RELEASE OF ARTICLES OF HIS LATE FATHER____________IN THE PRESENT CASE.

 

MOST RESPECTUFLLY SHOWETH :-

 

1.                 That the captioned FIR has been registered with the Police Station ---------- by the Applicant / Son of deceased Sh. --------- under Section 302/397/411/120B/34 of IPC which was trialed by this Hon’ble Court and convicted the accused persons by the judgment dated --------------.

 

2.                 That the Applicant is son of deceased Sh. Ishwar Bansal, who was killed by the accused persons. The said accused persons were sentenced for the offences under Section 302/397/411/120B IPC vide order dated ---------.

3.                 That during the investigation the following articles belongs to deceased Sh.--------- which were recovered and seized as case property by the Investigating Officer in the present case;-

4.                 That the Applicant through present application seeks the permission before this Hon’ble Court to release the aforesaid articles to the applicant as the matter was disposed off by this Hon’ble Court vide judgment dated ------------ and convicted / sentenced the accused persons in the captioned FIR proceeding.

5.                 In view of the aforesaid facts and circumstances coupled with the judgment as passed by Hon’ble Apex Court, the articles can be released to rightful owner (Applicant herein) and at the time of release photographs of the said articles may be taken so that maintain the record the actual production of the case property.

 

P R A Y E R

It is therefore, respectfully prayed that this Hon’ble Court may kindly release the aforesaid articles as mentioned in para 3 above to the Applicant /son of deceased, in the interest of justice.

Pass such further order or orders as this Hon’ble Court may deem fit and proper of the facts, in the interest of justice.
