APPLICATION FOR AND ON BEHALF OF THE APPLICANT / CONVICT XXXXXXX FOR DEPOSITING THE FINE AMOUNT OF RS.1,50,000/-.

MOST RESPECTFULLY SHOWETH :-

1.     That the applicant / convict had been arrested by the XXX on 16.11.2010 and convicted by Ld. Court of ShXXXXXXXXXX; Ld. Special Judge (NDPS Act) South Dist. Saket Courts, New Delhi vide judgment dated 20.02.20XX and sentenced to imprisonment of 13 years, along with fine of Rs.1,50,000/- with default simple imprisonment of one year vide order dated 23.02.20XX.

2.     That applicant / convict feeling aggrieved from the said judgment / order passed by this Hon’ble Court filed Crl. Appeal bearing No.XXX/20XX before Hon’ble High Court of Delhi in which also filed Application for suspension of sentence bearing Crl.M.B. No. XXXX/20XX which was dismissed by Hon’ble High Court on 30.05.20XX and also dismissed the Appeal by Hon’ble High Court vide judgment dated 27.12.20XX.

3.     In pursuance of the same, applicant had noticed that sentenced of fine of Rs.1,50,000/- imposed by this Hon’ble Court has not been deposited whereas applicant / convict could not inform his counsel about the same. That applicant / convict is poor family background and a foreign national (Afghanistan) and have no perokar / family member in India to arrange the said huge fine amount or engage any counsel who deposit the said fine amount on his behalf, furthermore the captioned appeal was filed by some other counsel. In view of same, applicant bonafidely is willing to deposit the fine amount of Rs.1.50 Lakhs as imposed by this Hon’ble Court.

4.     That the applicant is willing the deposit the fine as imposed by this Hon’ble Court.

PRAYER

        It is therefore, respectfully prayed that applicant / convict be allowed to deposit the fine as imposed by this Hon’ble Court while convicting and sentencing the applicant / convict vide its order dated 20.02.20XX and 23.02.20XX, in the interest of justice.

It is prayed accordingly.
