APPLICATION FOR WITHDRAWAL OF PRESENT CASE.

MOST RESPECTFULLY SHOWETH:-

1.           That the applicant / complainant has filed the present complaint against the respondents and the same is pending before this Hon’ble Court for today.

2.           That during the pendency of the present complaint, a mutually amicably settlement has been arrived between the parties in the intervention of friends, family and elder’s member of the society. As such the parties have finally decided settle all their disputes and obtain the decree of divorce with mutual consent. In view of the same both the parties have already granted first motion of divorce process vide order dated ……….. before the Hon’ble Court …………….. and it has been mutually agreed between the parties that before filing of the second motion petition for decree of divorce both the parties have withdrawn all the pending cases filed against each other and their family members.

3.           In view of the above, the applicant / complainant wants to withdraw the present case as all the disputes between the parties are resolved / settled.

          It is most respectfully prayed that the Hon’ble Commission may kindly be allow the present application and dispose of the present complaint, in the present case, in the interest of justice.
