APPLICATION ON BEHALF OF THE APPLICANT / DH FOR THE CANCELLATION OF THE BAILABLE WARRANT ISSUED AGAINST THE APPLICANT.

MOST RESPECTFULLY SHOWETH:

1.   That the present matter is pending before this Hon’ble Court for adjudication and the same is listed on 09.06.2XXX.

2.   That the Hon’ble Court, vide order dated 10.05.20XXXXissued the Bailable Warrant against the applicant / decree holder due to non-appearance before the Hon’ble Court.

3.   That on the last date of hearing i.e. 10.05.20XXX counsel for the applicant apprised this Hon’ble Court about the applicant was unable to appear as his newly office was inaugurated in Gurugram and his presence should be must there as head of the Company, resulting this Hon’ble Court was pleased to issue BWs against the applicant.

4.   That the non-appearance of the accused before the Hon’ble Court was not intentional but it was due to above said reason the accused could not appear before the court therefore the Hon’ble Court may cancel Bailable Warrant issued against the Accused and condone her non-appearance in the above stated facts and circumstances of the case.

5.   That the present application is presented with bona fide purpose and without any prejudice to the other parties therefore the same may be allowed in the interest of justice.

6.   That the applicant undertakes to be more cautious in future in appearing before the Hon’ble Court.

PRAYER

It is therefore most respectfully prayed before ther Hon’ble Court that ther court may graciously be pleased to cancel the Bailable Warrant issued against the Accused/ Applicant in the present matter, in the interest of justice.

Pass any such order as ther Hon’ble Court may deem fit and proper in the facts and circumstances of the case in the interest of justice.
