False Rape Allegations in Madhya Pradesh result in a Woman's Ten Years of Rigorous Imprisonment (RI).

October 20, 2023 - Dewas, Madhya Pradesh Sessions court in Dewas, Madhya Pradesh, has handed down a landmark conviction: 45-year-old Seema Bai was found guilty of falsely accusing a cousin of rape. According to the applicable provisions of the Indian Penal Code (IPC), she has been handed a ten-year harsh jail term. To get ownership of the property, the prosecution claimed that Seema Bai falsely accused her nephew-in-law of rape.


On June 3, 2017, Seema Bai, a widow from Barkheda Kotapai village, around 55 km from Indore, filed a complaint against her brother-in-law's 33-year-old son at the Barotha police station on the outskirts of Dewas District.


Following her allegation, the police wasted no time in opening a case. But as the inquiry progressed, it became clear that the charge was unfounded. Seema Bai was found to have produced false evidence during the rape trial, according to the prosecution.


A municipal court found the rape accusation to be false on June 18, 2019. Subsequently, it directed that Seema Bai be charged under many provisions of the Indian Penal Code (IPC), one of which being Section 195, which addresses the provision of false information or falsifying evidence. When it comes to perjury, or knowingly giving false evidence in a case, Section 195 of the Indian Penal Code is a crucial component.


Seema Bai Singh was found guilty of filing a false rape allegation and presenting false evidence before the court by the court of the Second Additional Sessions Judge, Dewas, under IPC Section 195. A severe ten-year jail term is in store for her. False rape claims have serious legal repercussions, such as jail, as this example shows.


The case was successfully prosecuted by Assistant District Prosecutor Jayanti Puranik. This ruling sets a very high bar for the intentional submission of fraudulent rape claims. Section 195 of the Indian Penal Code, which deals with the dissemination of false information and the fabrication of evidence, was pivotal in the final decision.
