Supreme court verdict on same- sex marriage not a surprise, because of there were omission in oral argument: Justice S.Murlidhar

Retired Judge S. Muralidhar Opined on the verdict on same-sex marriage that there were not enough and best arguments presented by the Petitioners.

 

Petitioners' written submissions were rich, and elaborate and captured the issues better but oral submission is not enough for the case. 


The former Orissa High Court Chief Justice added the case should have been heard for a longer period to enable a more detailed hearing on the complex issue.


Last month also refused to recognize the right of same-sex couples to enter into marriage or have civil unions by the majority of five-judge Constitution Bench of the Supreme Court.


However, the issue required a lot of thought, reflection, and public engagement on the part of the petitioners, he said. He added that the case could have been heard by the High Court first, like in the decriminalization of gay sex case.


He, however, added that he has no doubt that the issue would ultimately be resolved in favor of the LGBTQ+ community.


He said that there is no doubt that this issue has to be ultimately in favor of the petitioners. He doesn't want the petitioners to lose hope, in a democracy, there are a lot of opinions and stands of thought.
