Supreme Court Warns Against Misuse of Harsh Laws to Harass Citizens

In a crucial ruling reinforcing constitutional freedoms, the Supreme Court of India has cautioned state authorities against misusing stringent laws such as the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act to target individuals arbitrarily or suppress dissent.

A division bench, while quashing an FIR registered against a protestor, observed that “harsh laws must not become tools of oppression in the hands of the state.” The Court emphasized that such laws, though necessary in combating organized crime and serious threats, must not be invoked casually or punitively against common citizens exercising their democratic rights.

The Court reiterated the importance of proportionality and fairness in policing, adding that fundamental rights such as freedom of expression and peaceful assembly cannot be stifled by invoking special legislations without strict legal scrutiny.

This decision has drawn praise from civil rights advocates who argue that legal safeguards are crucial in a democracy, especially when laws have wide discretionary powers. The judgment serves as a reminder to all authorities to act responsibly and within the constitutional framework.
