Under Section 80 of Civil Procedure Code, 1908, it is mandatory to give legal notice of two months in government related suit. But there is an exemption, when there is a necessary to hear the case under clause 2 of Sec 80 of CPC

Yes, any suit against an act committed in the official capacity of a public servant or officer requires a 2 month prior notice before suit initiation. This notice is to be equipped with all the relevant information about the alleged offence including name of parties, residence, cause of action and the relief claimed.
