The most important and primary rule followed by the Indian Courts in child custody is “the welfare and best interest of the child “comes first. It matters more than what either parent wants (As per various Supreme Court judgments). The court's main concern is not who the better parent is, but what arrangement will ensure the overall well-being, happiness, safety, and development of the child be it financial, emotional, mental and physical.
