Who gets custody of the child after divorce — the mother or the father?

There is no fixed rule and automatic preference for either parent. However, courts often prefer giving custody of very young children (especially under the age of 5) to the mother, unless there are serious issues (e.g., abuse or neglect) and also assess the financial/emotional/educational welfare of the child. The final decision depends on each parent's ability to provide a stable and nurturing environment.
