A petition for restitution of conjugal rights (commonly called RCR) is filed under Section 9 of the Hindu Marriage Act, 1955. Similar provisions exist under other personal laws too. It is filed when one spouse has left the other without a valid reason, and the affected spouse asks the court to order their partner to return and live with them. This remedy is civil in nature, and while it does not enforce physical force or punishment, it provides a legal avenue to assert the marital right of cohabitation.
For example: if a husband and wife are living separately and the wife left the husband without giving any valid reason (like cruelty or danger to life), the husband can approach the court seeking restitution — essentially asking the court to direct the wife to return to live with him.
