Can a spouse file for judicial separation in case of cruelty or desertion?

Yes. Cruelty, desertion, adultery, and other grounds mentioned in Section 13 HMA are all valid grounds to seek judicial separation. If a spouse wants space or relief from a toxic marriage without fully dissolving it, judicial separation is a good option.

Yes, the act provides for the same grounds as divorce under sec 13 (1) and (2) as follows :
Cruelty
Desertion (2+ years)
Adultery
Conversion of religion
Mental disorder
Renunciation of the world
Venereal disease, etc.
