There have been concerns about misuse of DV laws. In Rajesh Sharma v. State of UP (2017), the Supreme Court issued guidelines to prevent misuse of Section 85, BNS, including setting up Family Welfare Committees. While these guidelines were partly revised later, courts continue to ensure fairness and proper inquiry. Men who are falsely accused can:
a) File for quashing of false DV proceedings under Section 528, BNSS
b) Submit evidence disproving abuse
c) Highlight contradictions in the woman’s allegations
The law is not meant to harass the innocent, and false complaints can backfire, leading to adverse costs and even defamation suits.
